PAC recommended that former Transport Minister Datuk Seri Chan Kong Choy be investigated by the Malaysian Anti-Corruption Commission (MACC) and the Police for unlawfully issuing three Letters of Support which has landed the country with the RM12.5 billion PKFZ scandal, citing the offence of criminal breach of trust under Section 14(1) of the Financial Procedure Act 1957 read together with Section 409B Penal Code.
However, despite being a member of the PAC myself, the above while seemingly a strong statement, may be a fruitless one. This is because, in the PAC's earlier interviews with the MACC, they have claimed that they have already investigated the letters and that they were "not abuses".
Tuan Tony Pua: Akan tetapi, sebelum ini, sebelum 2007 pun isu-isu salah guna kuasa telah pun dikemukakan dengan jelas terutamanya mengenai isu letter of support yang telah pun ditandatangani oleh pihak Menteri pada masa itu telah pun jelas dan telah pun diakui oleh ramai termasuk pihak-pihak daripada kerajaan bahawa seseorang Menteri Pengangkutan tidak mempunyai kuasa untuk memberikan apa-apa jaminan kewangan kepada pihak sesiapa dan apakah tindakan yang diambil pada masa itu? Kenapa pada masa itu tiada siasatan diambil untuk menyiasat sekiranya ada unsur-unsur salah guna kuasa. Sekurang-kurangnya salah guna kuasa dan boleh jadi isu penyelewengan pada masa itu.So, are they now going to say that the letters were now abuses of power by the former Minister of Transport? Even the Attorney General has admitted to the PAC that the letters are implicit guarantees ("bersifat jaminan"), but obviously MACC had better calibre investigators and prosecutors.

Letter of support yang dikatakan dikeluarkan oleh Menteri kepada OSK untuk pinjaman kepada Kuala Dimensi juga merupakan salah satu isu yang kita siasat dan kita complete siasatan itu dan Timbalan Pendakwa Raya berpendapat bahawa tiada kesalahan salah guna kuasa berlaku. Itu pendapat yang dikeluarkan oleh Timbalan Pendakwa Raya. Itu satu isu yang kita siasat Tuan Pengerusi.
Which brings to question, maybe it is the MACC which should be investigated on why they are so completely useless with something as straightforward as this.

YB, the fact that the Cabinet approved retrospectively the letteres make the letters "legalised"?

Many of the things and the people involved are so obvious in this PKFK issue. And as long as umno is connected you can bet your bottom $ it will be swept aside.

Good point. The MACC seems to come up with many dodgy "no-case" conclusions on a number of high profile cases. Now, is there a body that can investigate MACC for abuses of power or are they simply "untouchable" like the Toyolman?
Ahmad Said came out today and said that he has no idea what is KDSB. He must be living in his own hole. Maybe he also did not realise that Elvis is dead.
Both CKC and OC Phang could be framed up by someone in the power. But I think they will be set free without trial is done officially. There are too many people involve in this controversial whirlpool of mismanagement scandal. If these two persons are finally summoned to court for hearing, many people will be having night mare themselves. And shit in their pant.
A big hand of Bn will cover it up. This is Malaysia. There are bigger men involved in it.
Virtually, government is an institute of people. It gives protection to uphold those government moneys and properties. Money must be spent correctly and safely and go accordingly with the preset budget. But then they spend money wantonly and wastefully as though they are water in the river. It really make people feel sick and damage.
Yup spot on Tony, similarly to all those Royal Commissions BS that has got the country fooled.
We have been taken for a ride for so long that we don't even realise it. It becomes part of us and think it's normal!
